Terms of Use

Effective date: October 11, 2026

Please read Section 12 carefully. It contains an arbitration agreement and a class-action waiver that affect how disputes are resolved. You can opt out of arbitration within 30 days — see Section 12(i).

1. Accepting these terms

These Terms of Use (“Terms”) are an agreement between you and Awan Insurance Agency (“we,” “us,” “our”). They apply to awaninsurance.com and the calls, texts and emails that follow a request you make here. When you submit a form on this site you confirm that you agree to these Terms and to our Privacy Policy, and that you are at least 18 years old. If you do not agree, please do not submit a form; you can call us at (909) 864-3200 instead.

We may update these Terms. Changes are posted here with a new effective date and apply only going forward — they never apply to a dispute that arose, or a claim you filed, before the change was posted.

2. About us and this site

Awan Insurance Agency is a licensed California insurance agency (CA Lic #0H95098 · CA Agency Lic #6000199) at 27255 Messina St, Highland, CA 92346, and an authorized Farmers Insurance® agent. We are licensed to sell insurance in California. Farmers is our primary carrier, and we can also place coverage with other insurers through the Kraft Lake brokerage. Not every product or carrier is available in every situation. Nothing on this site, and no form you submit, binds or changes insurance coverage. Coverage starts only when an insurer accepts your application and confirms it in writing.

3. Quotes are estimates

Any price, savings or rate shown on this site or sent after you submit a form is an estimate based on the information provided. Final premiums, eligibility and coverage depend on each insurer’s underwriting, your verified information and the policy terms. The policy itself controls if anything on this site differs from it.

4. Information on this site

Articles and guides on this site are general information about insurance in California, not legal, tax or financial advice, and not a statement of the terms of any policy. Laws and the insurance market change; check current details with a licensed agent before you make a decision.

5. Your submissions

You agree that the information you submit is true, accurate and your own (or that you are authorized to submit it), and that the phone number you give is yours or one you are authorized to use. Insurers rely on it to quote and underwrite coverage, and inaccurate information can affect your premium or coverage. How we handle your information is described in our Privacy Policy; we never sell it or give it to lead buyers.

When you click a form’s submit button, you give Awan Insurance Agency your prior express written consent, by electronic signature, to contact you about your request, your insurance quote, and related insurance products and services by calls and text messages — including those made with automated technology or an artificial or prerecorded voice — at the number you provided, even if it is on a federal, state or internal Do Not Call list. The exact words appear under each form’s button.

7. Electronic records and signatures (E-SIGN)

By clicking a submit button on this site, you agree under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and California’s Uniform Electronic Transactions Act that:

8. Acceptable use

You agree not to: submit someone else’s information without permission; submit false information or automated or bulk submissions; probe, scrape or disrupt the site or its security; upload malware; or use the site for any unlawful purpose. We may block submissions that appear automated or abusive.

9. Intellectual property

The text, design and graphics on this site belong to Awan Insurance Agency or its licensors. You may view and print pages for your personal, non-commercial use. Farmers Insurance® and other insurers’ names and logos are trademarks of their owners and are used only to identify them; their use does not imply endorsement.

10. Third-party sites and services

This site links to and uses third-party sites and services (for example Farmers.com, insurer websites, Google Maps and address lookup). We are not responsible for their content or practices; their own terms and privacy policies apply.

11. Disclaimers and limitation of liability

This site and its content are provided “as is.” To the fullest extent the law allows, we disclaim implied warranties about the site, and we are not liable for indirect, incidental, special or consequential damages arising from your use of the site. Our total liability for any claim arising from your use of this website is limited to $100.

This section applies to your use of the website only. It does not limit any right you have under an insurance policy, the California Insurance Code, or any other law that cannot be waived, and it does not limit liability for our gross negligence or willful misconduct.

12. Dispute resolution and arbitration

(a) Talk to us first. Before starting arbitration or a court case, the person with the claim must send a written notice describing it and the relief sought to the other side (ours: 27255 Messina St, Highland, CA 92346, or mawan@farmersagent.com). We will both try in good faith to resolve it within 30 days. Any statute of limitations and any filing-fee deadline is tolled (paused) during this 30-day period.

(b) Agreement to arbitrate. If the dispute is not resolved, you and we agree that any dispute arising from this website, these Terms, or calls, texts or emails relating to a request made on this site, your insurance quote, or related insurance products and services will be resolved by binding individual arbitration, except as stated below. This agreement is governed by the Federal Arbitration Act.

(c) Rules and fees. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (adr.org). We will pay all AAA filing, administration and arbitrator fees for any arbitration you start, and we will pay them on time as California law requires. Each side pays its own attorneys’ fees unless the arbitrator awards them under applicable law. Hearings may be held by video or phone, or in person in the county where you live.

(d) Mutual and individual. These rules apply equally to you and to us. The arbitrator may award any individual relief a court could award on your individual claim. The arbitrator may not award public injunctive relief; any claim for public injunctive relief is severed, stayed until the individual arbitration ends, and then decided in court.

(e) Class-action waiver. You and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in a class, collective or representative proceeding. Claims decided in arbitration are heard by an arbitrator, not a jury; nothing in these Terms waives a jury trial for any claim decided in court. If this class waiver is found unenforceable for a claim, that claim will proceed in court, not in arbitration.

(f) Mass Arbitration. If 25 or more similar demands are filed against us by or with the help of the same or coordinated counsel, the AAA’s Mass Arbitration Supplementary Rules and fee schedules apply as the AAA administers them. Statutes of limitations are tolled while any demand awaits administration under those rules.

(g) Small claims. Either side may instead bring an individual claim in small claims court if it qualifies.

(h) Regulators. Nothing in these Terms stops you from filing a complaint with, or seeking relief through, any government agency, including the California Department of Insurance, the Federal Communications Commission, the Federal Trade Commission, or your state attorney general.

(i) Your right to opt out. You may reject this arbitration agreement by sending a written opt-out notice within 30 days after you first submit a form on this site. Email mawan@farmersagent.com with “Arbitration Opt-Out” in the subject, or mail it to 27255 Messina St, Highland, CA 92346. Include your name, address and phone number. Opting out does not affect any other part of these Terms or your coverage.

(j) Severability. If any part of this Section 12 is found unenforceable, the rest remains in effect, except as stated in (e).

13. Governing law and venue

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. Any claim that proceeds in court (because it is excluded from arbitration, you opted out, or arbitration does not apply) will be brought in the state or federal courts located in San Bernardino County, California, unless the law gives you the right to sue where you live.

14. General terms and contact

These Terms and our Privacy Policy are the entire agreement about your use of this website. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of our agency.
