Getting California car insurance after a coverage lapse feels urgent, and it is — but it's also fixable. Here's what the DMV does when your policy ends, what driving uninsured can cost, what California law says about your rate, and the steps to get covered again.

Quick Answer

California car insurance after a coverage lapse is still available, and Insurance Code §1861.02(c) bars insurers from using the absence of prior coverage, by itself, to set your rate or deny the Good Driver Discount. The lapse still has consequences: your insurer reports the cancellation to the DMV, registration is suspended if no new proof arrives within 45 days, and reinstating costs $14. Get a policy in force before you drive again.

Maybe the autopay bounced, or money got tight and you let the policy go. Now there's a DMV letter on the counter, or you're worried one is coming. Take a breath. A lapse is one of the most common problems we help drivers fix. Here's what happens and what to do this week.

## What Counts as a Coverage Lapse in California?

A coverage lapse is any stretch of time when a car registered in your name has no auto liability policy in force — whether that's one day or one year, and whether you meant it or not.

California requires every registered vehicle to carry at least 30/60/15 liability: $30,000 for injury or death to one person, $60,000 for more than one person and $15,000 for property damage ([Source: California DMV →](https://www.dmv.ca.gov/portal/vehicle-registration/insurance-requirements/)). Comprehensive or collision alone doesn't meet it, so a "storage only" policy on a registered car still counts as a lapse. Our guide to [California's 30/60/15 minimums](https://awaninsurance.com/blog/auto-insurance/california-30-60-15-auto-insurance-requirements/) explains what those limits do and don't pay for.

💳

### A missed payment

The most common cause we see: an expired card or closed autopay account.

📬

### A renewal that never got paid

The renewal premium wasn't paid, so the policy expired.

🔁

### A gap while switching

The old policy ended before the new one began. Even a weekend counts.

🅿️

### A parked car

Coverage dropped, but the car stayed registered and the DMV wasn't told.

✈️

### Time away

Deployment or a long trip, with the car left registered at home.

📉

### A tight month

Coverage dropped to save money. Understandable and fixable, with real consequences.

## What Does the DMV Do When Your Car Insurance Lapses?

When your car insurance lapses, your insurer reports the cancellation to the DMV electronically, and if no replacement policy reaches the DMV within 45 days, your vehicle's registration is suspended.

The system already knows your policy ended. California insurers are required by Vehicle Code section 16058 to electronically report private-use vehicle insurance information to the DMV ([Source: California DMV →](https://www.dmv.ca.gov/portal/vehicle-registration/insurance-requirements/)). The DMV suspends a registration when no insurance reaches it within 30 days of a new registration card, when a cancelled policy isn't replaced within 45 days, or when false proof was used ([Source: California DMV →](https://www.dmv.ca.gov/portal/vehicle-registration/insurance-requirements/suspended-vehicle-registration/)).

45 daysTime for a replacement policy to reach the DMV after it's notified of a cancellation, before registration is suspended. California DMV.

$14Registration reinstatement fee, paid along with proof of insurance. California DMV.

30 daysWindow for insurance information to reach the DMV after a new registration card is issued. California DMV.

The DMV mails you a notice first. Once the registration is suspended, the vehicle "may not be operated or parked on public roadways until proof of insurance is submitted" — so it can't even sit on your street.

Reinstating is paperwork: proof from a company licensed in California, with "California" at the top of the card, plus the $14 fee, online, by mail, at a kiosk or by phone. Have your insurer's NAIC number, policy number, plate and the last five characters of your VIN ready.

## What Happens If You Drive Without Insurance in California?

Driving without insurance in California can mean a fine of $100 to $200 plus penalty assessments on a first conviction, possible impound, and — if you crash — a license suspension of up to four years.

Vehicle Code section 16029 sets the fine for a first conviction at not less than $100 and not more than $200, plus penalty assessments, rising to $200 to $500 plus assessments for a subsequent conviction within three years. The court can also order the vehicle impounded for good cause ([Source: California Vehicle Code §16029 →](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=16029)).

Officers can't stop you just to check for insurance (Vehicle Code section 16028), but the ticket is the small part. The crash is the big one:

* **Your license.** The DMV handbook says your driving privilege "will be suspended for up to four years" if you're in a collision without proper insurance. You can get it back during the last three years by filing an SR-22 and keeping it on file ([Source: California DMV Driver Handbook →](https://www.dmv.ca.gov/portal/handbook/california-driver-handbook/financial-responsibility-insurance-requirements-and-collisions/)).
* **The report.** A collision with more than $1,000 in damage, or any injury, must be reported to the DMV within 10 days on form SR 1.
* **The damage you caused.** With no insurer to pay the other driver, the bill is yours.
* **Your own injuries.** Under Civil Code section 3333.4, an uninsured owner or driver generally can't recover non-economic damages — pain, suffering, inconvenience — even when the other driver caused the crash, with a narrow exception if that driver is convicted of DUI ([Source: California Civil Code §3333.4 →](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=CIV&sectionNum=3333.4)).

## Can an Insurer Charge You More Because of a Lapse in California?

Not for the lapse by itself: California Insurance Code section 1861.02(c) says the absence of prior auto insurance, in and of itself, can't be used to set your rate, your Good Driver Discount eligibility or whether you're insurable.

This is a Proposition 103 rule. The statute's words are "the absence of prior automobile insurance coverage, in and of itself, shall not be a criterion for determining eligibility" for the Good Driver Discount, or for rates, premiums and insurability generally ([Source: California Insurance Code §1861.02 →](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=INS&sectionNum=1861.02)). Section 1861.02(a) ranks your driving record first, then annual miles, then years of experience.

"In and of itself" matters. Here's what it does and doesn't protect:

| After a lapse… | Can it count against you? |
| --- | --- |
| **The gap in coverage alone** | No Not a criterion for rates, Good Driver eligibility or insurability (§1861.02(c)) |
| **A ticket, at-fault accident or DUI during the gap** | Yes Your driving record is the first rating factor (§1861.02(a)) |
| **A loyalty (persistency) credit with your old insurer** | Yes It applies only at renewal with your current insurer, so cancelling ends it |
| **Years licensed toward the Good Driver Discount** | No The test counts years licensed, not years insured (§1861.025) |

California's rating regulation lets an insurer give a persistency (loyalty) credit at renewal to its current insured, but not based on coverage with a non-affiliated insurer ([Source: Cal. Code Regs. tit. 10, §2632.5 →](https://www.law.cornell.edu/regulations/california/10-CCR-2632.5)). A 2003 law that tried to make that credit portable between companies was struck down in 2005 ([Source: California Department of Insurance →](https://www.insurance.ca.gov/0250-insurers/0300-insurers/0200-bulletins/bulletin-notices-commiss-opinion/upload/notice-of-invalidation-of-sb841.pdf)).

The Good Driver Discount test in section 1861.025 looks at your license and record: three years licensed, no more than one violation point, no at-fault injury accident and no DUI conviction in the lookback period ([Source: California Insurance Code §1861.025 →](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=INS&sectionNum=1861.025)). A lapse doesn't appear anywhere on that list. See [what drives car insurance prices in California](https://awaninsurance.com/blog/auto-insurance/how-much-is-car-insurance-in-california/) for the factors that do.

Be straight on the application

Tell us about any tickets or accidents during the gap up front. An accurate application prices once; a misstatement found later can mean a re-rate or a cancelled policy.

## Why Did Your Policy Lapse, and Were You Owed Notice?

California generally requires an insurer to give you at least 10 days' notice before cancelling an auto policy for nonpayment and 20 days for most other reasons, and you can stop a nonpayment cancellation by paying within that 10-day window.

Under Insurance Code section 662, a nonpayment cancellation takes effect only if you haven't paid by the end of those 10 days ([Source: California Insurance Code §662 →](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=INS&sectionNum=662)).

Under section 663, your insurer has to send a renewal offer at least 20 days before your policy expires — conditioned on paying the premium — or a nonrenewal notice at least 30 days before expiration. If it does neither, your existing policy stays in force for 30 days after it finally sends one, unless you buy replacement coverage first ([Source: California Insurance Code §663 →](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=INS&sectionNum=663)). Got the offer and didn't pay? The policy ends on its expiration date.

Not sure your policy really ended? Call your old insurer and ask for the exact date and where the notice went. If the company dropped you for another reason, our guide to [what to do when an insurer drops you](https://awaninsurance.com/blog/home-insurance/what-happens-when-your-insurer-drops-you-and-what-to-do-next/) walks through the difference between cancellation and nonrenewal.

## How Do You Get Covered Again After a Lapse?

To get covered again after a lapse, buy a new policy before you drive, then confirm the DMV has your proof of insurance and pay the $14 fee if your registration was already suspended.

Here's the order we walk clients through:

* **Park it until you're insured.** Not even a quick drive to the DMV.
* **Bind a new policy.** At least 30/60/15; higher limits and uninsured motorist coverage are worth pricing.
* **Check the DMV status.** If you got a suspension notice, submit proof and the $14 fee yourself rather than assuming it cleared.
* **Set up autopay from an account you won't close.** Most lapses are payment accidents, not decisions.
* **Answer any license notice separately.** A DMV notice on your license tells you whether an SR-22 is required.

We write coverage for drivers coming back from a lapse through Farmers, the Farmers family including Bristol West, and our brokerage access to other California carriers. See how that works on our [California auto insurance page](https://awaninsurance.com/auto-insurance), or [compare quotes the right way](https://awaninsurance.com/blog/auto-insurance/compare-california-car-insurance-quotes/) before you buy.

Switching? Overlap, don't gap

When you switch companies, start the new policy before the old one ends. Cancelling first is how careful people end up with a DMV letter.

## What If Your Car Is Parked and You Want to Drop Insurance?

If a registered car is off the road and you want to drop insurance, file an Affidavit of Non-Use (REG 5090) with the DMV before you cancel, then file Planned Non-Operation at renewal if it's still parked.

The DMV is direct about this: "To prevent a vehicle registration suspension, you must notify DMV before you cancel your insurance." The Affidavit of Non-Use is for a currently registered vehicle you aren't driving that isn't parked on a California roadway. After you file it, the insurance may be cancelled. You can't file one once the registration has expired ([Source: California DMV →](https://www.dmv.ca.gov/portal/vehicle-registration/insurance-requirements/)).

When renewal comes around and the car is still parked, you either pay the renewal fees or file for Planned Non-Operation (PNO). PNO means the vehicle won't be driven, towed, stored or parked on public roads for the entire registration year. The DMV accepts PNO filings up to 60 days before registration expires or up to 90 days after, with late penalties after expiration. It also warns that "California has no grace period" ([Source: California DMV →](https://www.dmv.ca.gov/portal/vehicle-registration/vehicle-registration-renewal/file-for-planned-non-operation/)). To drive it again, pay full registration fees and get insurance in force first.

Keeping comprehensive on a garaged car protects it from theft or fire, but it doesn't meet the liability requirement, so pair it with the ANU or PNO filing.

## Do You Need an SR-22 or the Low Cost Auto Program After a Lapse?

A lapse alone doesn't require an SR-22 — you need one only when the DMV or a court makes proof of insurance a condition of your license, such as after an uninsured crash; if money caused the lapse, California's Low Cost Auto program may fit.

An SR-22 is a certificate your insurer files with the DMV after license actions like the uninsured-collision suspension above. If your notice asks for one, our guide to [SR-22 insurance in California](https://awaninsurance.com/blog/auto-insurance/sr-22-insurance-in-california-who-needs-it-and-for-how-long/) covers who needs it and for how long, and our [SR-22 filing page](https://awaninsurance.com/sr22) explains how we handle the filing.

If cost is why the policy lapsed, look at the California Low Cost Auto Insurance program. Its published qualifications are a valid California driver's license, income within the program's guidelines, a vehicle valued at $25,000 or less, age 16 or older (under 18 must be legally emancipated) and a good driving record or new-driver status ([Source: California Low Cost Auto Insurance Program →](https://www.mylowcostauto.com/get-started/qualifications)).

Our [California Low Cost Auto program guide](https://awaninsurance.com/blog/auto-insurance/california-low-cost-auto-insurance-program-guide/) walks through the income test, coverage limits and how to apply.

## The Bottom Line

A lapse in California is serious but rarely permanent. The DMV learns about it electronically, gives you 45 days to get new proof on file before suspending your registration, and charges $14 to reinstate. Driving during the gap is where the real damage happens: fines, possible impound and, after a crash, a license suspension of up to four years. What the lapse alone can't do, under Insurance Code section 1861.02(c), is set your rate or cost you the Good Driver Discount.

If your policy has lapsed, or you're not sure whether it has, call the Awan Insurance team at (909) 864-3200 or [start a quote online](https://awaninsurance.com/quote). ## Related Questions

### How long can my car insurance lapse before the DMV suspends my registration?

The DMV's published rule is 45 days. Once your insurer reports a cancellation, your registration is suspended if no replacement policy is submitted within 45 days, and the DMV mails a notice before that happens. That window is for paperwork, not driving: you are uninsured from the moment the policy ends.

### Can I lose my Good Driver Discount because I had no insurance for a while?

Not for the gap alone. Insurance Code section 1861.02(c) bars insurers from using the absence of prior insurance, in and of itself, to decide Good Driver Discount eligibility. The test in section 1861.025 looks at years licensed, violation points, at-fault injury accidents and DUI convictions — so a ticket during the lapse still counts.

### Do I have to keep insurance on a car I'm not driving in California?

Only while it stays registered for road use. If the car is off the road and not parked on a public street, file an Affidavit of Non-Use (REG 5090) with the DMV before cancelling insurance, then file Planned Non-Operation at renewal if it is still parked. Cancelling first leads to a registration suspension.

### Can an uninsured driver sue for pain and suffering in California?

Generally no. Civil Code section 3333.4 says an owner of an uninsured vehicle, or a driver who can't show financial responsibility, can't recover non-economic damages such as pain and suffering, even if the other driver caused the crash. The section does not bar economic damages such as medical bills and lost wages. There is a narrow exception for uninsured owners hit by a driver convicted of DUI.

### Is there a grace period for a late car insurance payment in California?

Not a set grace period, but there is a notice rule. Insurance Code section 662 requires at least 10 days' notice before an insurer cancels for nonpayment, and the cancellation takes effect only if you don't pay within that 10-day window. A missed renewal payment works differently: the policy simply expires.
